1. Acceptance of Terms

By accessing or using ResumeCoach.me ("Service"), operated by Xenco Labs ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

ResumeCoach.me provides AI-powered resume optimization services, including:

• Resume analysis using our SPOR (Skills, Performance, Optimization, Relevance) scoring system
• Job-specific resume optimization
• Integration with O*NET government occupational data
• Job search functionality powered by Indeed data
• Resume download in multiple formats

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account and use the Service.

4. Subscription Plans and Payment

4.1 Free Plan

We offer a limited free plan that allows you to analyze and optimize a limited number of resumes.

4.2 Paid Subscriptions

Paid subscriptions (Pro, Accelerator, Agency) provide:

• Unlimited resume optimizations
• Advanced features and priority processing
• Additional export formats

4.3 Billing

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your billing period.

4.5 Refunds

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with our Service, contact us within 30 days of your initial purchase for a full refund. Refunds are not available after this period or for renewal charges.

5. User Content and Data

5.1 Your Content

You retain ownership of all content you submit, including resumes and job descriptions. By submitting content, you grant us a limited license to process, analyze, and store it for the purpose of providing our Service.

5.2 Accuracy of Information

You are responsible for the accuracy of information in your resume. We optimize and reformat your content but do not verify its truthfulness. Submitting false information in a resume may be illegal and is prohibited.

5.3 Data Privacy

Our collection and use of your data is governed by our Privacy Policy.

6. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Submit fraudulent or misleading resume content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Scrape, copy, or redistribute our content without permission
• Resell or commercially exploit our Service without authorization
• Use automated tools to access the Service (except as permitted)
• Violate any applicable laws or regulations

7. Intellectual Property

7.1 Our Property

The Service, including our SPOR algorithm, website design, logos, and content (excluding user content), is owned by Xenco Labs and protected by intellectual property laws.

7.2 Third-Party Content

Job data from Indeed and occupational data from O*NET are used under their respective terms and remain the property of their owners.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee of Results

We do not guarantee that using our Service will result in job interviews or employment. Resume optimization improves your chances but hiring decisions are made by employers.

8.3 Third-Party Services

We are not responsible for third-party services integrated with our platform (Clerk, Stripe, Indeed, etc.) and their availability or performance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XENCO LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Xenco Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account data after 90 days
• You may request export of your data before deletion

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Small claims court actions are exempt from this requirement.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits or class-wide arbitration.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
